Terms of Use

These terms govern your use of Arcadia (the app and playarcadia.app), operated by Murray IT Stack, LLC, a Wisconsin limited liability company doing business as Arcadia ("we", "us"). By using Arcadia you agree to them and to our Privacy Policy. If you do not agree, please do not use Arcadia.

Who can use Arcadia

• Arcadia is for everyone, but different games are shown to different age ranges based on the birth year you choose. Please answer honestly.
• Children under 13 may use the kids and all-ages games only. A parent or guardian is responsible for a child's use, and creates and manages child profiles.
• Games marked 18+ are for adults only.

Free play, credits and chips

• Arcadia is free to play. Some games use credits that refill slowly over time, can be earned by playing, and can be earned by watching optional ads. Where the iOS app offers credit packs, they are purchased through Apple and are not refundable by us except as Apple's rules or the law require.
• Credits and play chips have no cash value. They are not property, cannot be sold, transferred, withdrawn or exchanged for money, goods or prizes, and we may adjust balances to correct errors or fraud.
• Play chips in our casino-style games are free and can never be purchased or converted into credits or money.

18+ casino-style games

Afterglow 21 and Fossil Fever are simulated gambling games for adults (18+) played with free play chips. They are for entertainment only: no real-money gambling, no wagering of anything of value, no prizes of real-world value, and winning in these games does not mean you will win in real-money gambling. Ads

Arcadia may show ads to players 13 and over. Rewarded ads are always optional: you choose each one and the reward is delivered only after you watch it. Please do not click ads except because you are interested in them; we do not ask or encourage anyone to click ads, and artificially generating ad views or clicks (bots, scripts, repeated clicking) is prohibited and may lead to loss of rewards or access. Ads are provided by third parties; we are not responsible for advertisers' products or sites.

Acceptable use

Do not: cheat, exploit bugs or tamper with balances or saves; use bots, scripts or automation; attempt to access accounts or data that are not yours; interfere with the service or reverse engineer it except where the law allows; copy or redistribute our games, art or code; or use Arcadia for anything unlawful.

Our content and your license

The games, art, audio, code and the Arcadia name and logo belong to Murray IT Stack, LLC or our licensors and are protected by law. We give you a personal, non-exclusive, non-transferable, revocable license to play Arcadia for your own non-commercial entertainment. Some third-party assets are used under their own licenses. Nothing in these terms transfers any ownership to you.

Accounts and cloud save

Cloud save uses a guest account created automatically, or an optional email or Apple sign-in for players 13+. Keep your sign-in secret; you are responsible for activity on your account. You can delete your account at any time in Profile.

Availability and changes

Arcadia is provided as-is and may change, be interrupted or be discontinued, including removing games, credits or features. We may suspend or end access if these terms are broken.

Disclaimers and limits of liability

To the fullest extent the law allows, Arcadia is provided "as is" and "as available" without warranties of any kind, and Murray IT Stack, LLC and its members and contractors are not liable for indirect, incidental, special or consequential damages, or for lost progress, credits or chips. Our total liability for any claim relating to Arcadia is limited to the greater of the amount you paid us in the 12 months before the claim and US$50. Some places do not allow these limits, so they may not apply to you. Nothing here limits rights you have under consumer protection law that cannot be waived.

Governing law

These terms are governed by the laws of the State of Wisconsin, USA, without regard to conflict-of-law rules. Courts located in Wisconsin (including Calumet County) have jurisdiction over disputes, except where your local law gives you the right to bring a claim where you live.

Changes to these terms

We may update these terms; the date above shows the latest version. Continuing to use Arcadia after a change means you accept it.
